Terms and Conditions

These Terms of Use (the "Terms") apply to the website https://www.leadershipmaturity.ai, its subdomains (the "Website"), and services offered through the Website.

The Website is owned by LeadershipMaturity.ai OÜ, 16996579, Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 5, 10145 (the "Company").

By accessing or using the Website and its services (collectively, the "Services"), you ("User") agree to be bound by these Terms. If you disagree with these Terms, please do not use the Services.

The Company may change or modify these Terms at any time at its sole discretion. We will post the revised Terms to the Website with an updated "Last Revised" date. Changes will be effective immediately upon posting. Your continued use of the Website constitutes acceptance of such changes.

1. PREAMBLE

Company provides cognitive AI-driven assessments, delivering reports on individuals' stages of development based on validated psychological models, including recommendations to enhance leadership maturity and effectiveness.

You agree to use the Services only for purposes that are permitted by the Terms and any applicable laws, regulations, or generally accepted practices or guidelines in the relevant jurisdictions.

Eligibility and intended use. The Services are intended for adults (18+). They are for developmental and informational purposes and must not be used as the sole basis for employment, promotion, selection, or clinical/medical decisions.

2. INTELLECTUAL PROPERTY AND USER DATA RIGHTS

2.1. All content on the Website is the property of the Company.

2.2. Users may not copy, duplicate, print, or circulate the information on this Website without prior written consent.

2.3. Users retain rights to their submitted data. User data may be used in an aggregated, anonymized form for research purposes only with explicit user consent.

2.4. Data retention with research consent is two years; it is deleted afterwards. Data is anonymized by removing all identifiable information prior to storage.

2.5. Company grants you a limited, non-exclusive, non-transferable license to use the Website and its Content for personal and non-commercial purposes.

2.6. Company retains all ownership rights to artifacts generated through the Services, including assessment reports and recommendations. Users are granted a non-exclusive, non-transferable license to use these materials for personal growth purposes only, not for commercialization or public distribution.

3. DATA PROTECTION AND PRIVACY

3.1. Company complies with GDPR and applicable data protection laws. Users have the right to access, rectify, erase, restrict processing, and obtain a copy of their data by contacting us.

3.2. User data is stored anonymously on securely encrypted media within the EU and deleted within one month unless opted in for research purposes.

3.3. Users may request data deletion at any time by contacting the Company and specifying the date and time they took the assessment (as no personal information is stored to identify the data).

4. CONFIDENTIALITY AND LIMITED LIABILITY

4.1. Company is not liable for any loss or damage resulting from data transmissions over the Internet.

4.2. Users are prohibited from unauthorized use, copying, or distribution of Website content, and content of our products and services such as assessments, assessment result reports and recommendations. 

4.3. You will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Services.

5. THIRD-PARTY CONTENT

5.1. Company is not responsible for third-party content or links on the Website.

5.2. Your use of such Third Party Content is at your own risk.

6. APPLICABLE LAW AND JURISDICTION

6.1. These Terms are governed by the laws of Estonia. If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections that apply in the country where you habitually reside.

6.2. If you are acting on behalf of a business, the courts of Estonia (Harju County Court, Tallinn) shall have exclusive jurisdiction.

6.3. If you are a consumer, you may bring claims in Estonia or in your country of habitual residence, as permitted by applicable law. Any limitation on class actions or representative proceedings applies only to the extent permitted by law.
 

7. LIMITATION OF LIABILITY

7.1. Company's liability is limited to the extent permitted by law.

7.2. Assessments and reports are for informational purposes only and should not be considered professional advice. We recommend that Users work with professionals (such as trained and certified coaches, mentors, trainers) and/or therapists when necessary. 

7.3. No Medical Advice: Nothing provided to you through the Services constitutes therapy or medical advice. There is no therapist-patient relationship created in connection with the Services. Services are not a substitute for the advice of a medical professional and any information provided through the Services cannot be relied upon when making life and/or career decisions. If you require therapeutic and/ or medical advice, please consult with a medical professional. 

7.4. If you choose to use the LeadershipMaturity.ai coaching referral service, your program may provide access to, or recommendations for, matching with professional coaches. Professional coaches included in the referral network undergo a rigorous selection process to ensure high standards of qualification and expertise. However, LeadershipMaturity.ai cannot guarantee the actions of these coaches or the consequences thereof, and disclaims any liability related to their conduct or the outcomes of their services. LeadershipMaturity.ai makes no representations or warranties regarding the qualifications, expertise, or quality of services provided by such external coaches. Any services provided by these external providers do not constitute part of the Services as defined under these Terms. Unless explicitly stated otherwise, your relationship with any such provider is wholly separate from your relationship with LeadershipMaturity.ai, and LeadershipMaturity.ai disclaims any liability for services rendered by such third-party providers.

7.5. Users acknowledge that reliance on the assessments and recommendations is at their own risk.

8. ETHICAL USE OF AI

8.1. Company is committed to fair, unbiased, and transparent use of AI technology.

9. DISCLAIMER OF WARRANTIES

9.1. The Services are provided "as is" and "as available" without any warranties, expressed or implied.

9.2. Company does not warrant that the Services will meet your requirements or be uninterrupted, secure, or error-free.

10. INDEMNIFICATION

10.1. You agree to indemnify and hold Company harmless from any claims arising from your use of the Services or violation of these Terms.

11. DISPUTE RESOLUTION

11.1. Parties shall attempt to resolve disputes through friendly consultation and, if helpful, mediation. If you are a consumer, nothing in these Terms limits your right to bring a claim in court or to use any available consumer dispute resolution options. If you are acting on behalf of a business, any arbitration will take place only by mutual written agreement of the parties.

12. SEVERABILITY

12.1. If any provision of these Terms is found unenforceable, it shall be deleted without affecting the remaining provisions.

14. PAYMENTS, CANCELLATION AND REFUNDS

14.1 Payments.
Payments for our Services are processed through third-party payment providers (for example, PayPal). The name of the payment provider (or its descriptor) may appear on your bank or card statement.

 

14.2 How to request a refund.
To request a refund, contact us at refunds@leadershipmaturity.ai and include your order details (such as

the email used at checkout or assessment ID if available, and purchase date and time). Where applicable, you may also request a refund through the payment provider used at checkout.

14.3 Refund window (general policy).
Unless a longer period is required by mandatory law, you may request a refund within 14 days of purchase.

14.4 Refunds for billing errors and access issues.
We will issue a refund if:
- you were charged in error (for example, a duplicate charge); or
- a technical issue on our side prevented reasonable access to the Service and we could not resolve it within a reasonable time; or
- the assessment results report has not been materially delivered.
We may also offer a refund in other situations on a case-by-case basis.
 

14.5 Digital services and assessment delivery.
Because our Services include digital services and digital deliverables (such as assessment access and reports), once a results report has been delivered, refunds are generally not offered, except where required by law or where the Service is faulty or not as described.
 

14.6 Refund method and timing.
Approved refunds are issued to the original payment method where possible. Processing times vary by payment method and provider. We aim to resolve access issues quickly and will refund where we can’t make the Service available as promised.
